In the normal course of doing business SightLogix collects and uses personal data in connection with our marketing and customer interactions. We take the protection of your privacy and your personal data very seriously. SightLogix aspires to operate with the highest level of integrity while conducting business, and to process your Personal Data in accordance with all applicable data protection legislation, in all the markets within which SightLogix operates.

The following Privacy Policy describes how SightLogix collects and uses personal data. On one hand it describes how we collect and process personal data via our website (see section B. below) and on the other it describes our collection and use of personal data in other ways you may interact with us (see section C. below).

In relation to personal data, this Privacy Policy explains:

This section describes how we process personal data via our Website.

1. Personal data we collect

1.1.         Personal data we collect through our Website

1.1.1      Personal data we collect when you visit a SightLogix Website

Through the Sites: We collect information through the Sites, e.g., when you request SightSurvey, register for a webinar, contact us, subscribe to our email list, download content (e.g. whitepapers), or register to use our Sites. Offline: We collect information from you offline, such as when you attend one of our events, during phone calls with sales representatives, or when you contact a SightLogix representative.

Through You: SightLogix collects information such as your location or your preferred means of communication when you voluntarily provide it. Unless combined with Personal Data, this information does not personally identify you or any other user of the Sites.

Information from Other Sources: In order to enhance our ability to provide relevant marketing, offers, and services to you, we obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms, as well as from other third parties.

Through Your Browser or Device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, and the name and version of the Sites you are using. Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP Address may be identified and logged automatically in our server log files whenever you access the Sites, along with the time of the visit and the page(s) that you visited. Collecting IP Addresses is standard practice and is done automatically by many websites, applications and other services. Act-On uses IP Addresses to calculate usage levels of the Sites, help diagnose problems with its servers, administer the Sites, and for monitoring the regions from which you navigate to SightLogix Sites.

Through Cookies and Other Similar Technologies: “Cookies” include commonly used pieces of information in the form of small files that are placed on an individual’s device to enable the individual to more easily communicate and interact with the Sites. When you visit our Sites, we may send one or more cookies to your device. They enable us to store information about your device which helps us, amongst other things, to provide you with a good experience when you browse our Sites and enhance the level of services and functions provided. We also use third parties to serve advertisements on other websites that may be of interest to you, based on information collected about your use of our Sites and other websites. To do so, these companies may place or recognize a unique cookie or similar on your browser. SightLogix recognizes automated browser signals regarding tracking mechanisms, which may include ‘do not track’ instructions.

By Aggregating Information: Aggregated Personal Data does not personally identify you or any other user of the Sites (for example, we may aggregate Personal Data to calculate the percentage of our users who have a particular telephone area code).

1.2        Personal data we collect from third parties

We may also use and collect your personal data from other sources such as public registers or companies that provider specialist information or services to SightLogix

2. Why do we collect and use your personal data?

2.1        We process the personal data as required to establish and fulfill a contract with you and to provide services you requested, for example if you register a SightLogix product with us.

2.2        We further process personal data as required by SightLogix to enable our business and pursue our legitimate interests. In particular, we use your data for the following purposes:

  • To manage and improve our Websites and Apps.
  • To help develop our Websites, product range, training services and IT systems.
  • To detect fraud and any other crime.
  • To interact with you upon your request.
  • To analyze how Website visitors use and browse the Website, how they view products, how they respond to advertising and offers presented on the Website, which all helps us understand what our customers want from SightLogix.
  • To improve the services we can offer our customers.

2.3        We will only send you relevant and personalized marketing communications. You have the right to withdraw your consent at any time. In the case of electronic direct marketing emails, there are instructions in the bottom of the communication as to how you can be removed from our lists.

3. What is the legal basis for our processing of your data?

We base the above-mentioned processing activities of your personal data on the following legal basis:

  • To establish and fulfill a contract with you, your personal data is processed based on a statutory permission under the GDPR.
  • To enable our business and pursue our legitimate interests, your personal data is processed so that we may fulfil your request to answer questions about products of interest to you, to provide access to training and other assets, and to assist with support, service, warranty, and product safety issues.
  • Personalized marketing communication is sent to you based on your consent.
  • We collect personal data from third parties based on consent from clients who have requested information from us through a third party or vendor.
4. Sending marketing communication and managing your marketing preferences

4.1        We will only send you relevant and personalized marketing communications. You have the right to withdraw your consent at any time. 5. Social Media Buttons

On our Website we use the following social media plug-ins: Twitter, LinkedIn, and YouTube. The plug-ins can be identified by the social media buttons marked with the logo of the provider of the respective social media networks.

When you surf on one of our Website containing such plugin, your browser loads the plug-ins and social media buttons directly from the respective social media network and integrates them into the site. Through this process the respective social media network will receive the information that your browser has loaded one of our sites, even if you do not have a profile at the respective social network or are not currently logged into your profile. This information (including your IP address) is transmitted directly from your browser to a server, which may be located outside the European Economic Area and stored there.

If you are logged into your profile, the respective social network can immediately associate your visit to our Website with your profile. The social media network will receive further information, if you interact with the plug-ins we have integrated into our site (e.g. click on one of the buttons). You can prevent such association by logging out of your account before visiting our Website or by using one of the available blockers available as add-ons for your browser.

6. Google Analytics

Our Website uses Google Analytics, which is a web analytics service provided by the third-party provider Google, Inc. (“Google”). Google Analytics is used for the purpose of evaluating your use of our Website, compiling reports on Website activity and other services relating to Website activity and internet usage. The information generated by the cookie about your use of the Website is usually transmitted to and stored by Google on servers in the United States. This transfer is covered by Google’s Privacy Shield certification and a separate data processing agreement that we have concluded with Google. On this Website we have also activated the IP anonymization tool provided by Google to help protect your privacy. This means that your IP address will automatically be shortened after it is collected so it can no longer be connected to you (see https://support.google.com/analytics/answer/2763052). 7. How do we share the personal data we collect?

SightLogix does not share your personal data unnecessarily, or without a clearly defined purpose, and not without ensuring all the necessary protections are in place, to ensure SightLogix meets all its legal obligations around the storage, transmission and processing of personal data, as set out by all relevant legislations within the markets that SightLogix operates.

When we share your personal data, we do not allow any third-party partners to use it for their own marketing purposes. When we do share your personal data, you can be assured that it will only be shared with third-party partners who will protect your personal data as closely as SightLogix does.

7.1          Affiliates

We may share your personal data with Affiliates of SightLogix, meaning any company, corporation or other entity that directly or indirectly controls, or is controlled by, or is under common control with SightLogix so that they may assist you locally with the sale of one of our products, service, support, training, or other tasks that need local representation. SightLogix’s internal access permissions are strictly controlled, and so SightLogix also does not allow access to your personal data by SightLogix employees, unless the employee requires access to fulfil their role and responsibilities.

7.2          Service Providers

Personal data may also be shared with third party service providers, who will process it on behalf of SightLogix for the purposes above. SightLogix only works with carefully selected Service Providers to carry out certain functions. SightLogix does so, because these Service Providers are able to offer a specialist service that SightLogix either cannot or is not yet able to offer itself. This might include website hosting, maintenance and call center operation. We only share the personal data that enables our Service Providers to fulfil these tasks and services.

7.3          Sharing personal data with other organizations

We may share personal data with other organizations, under the following circumstances:

  • If the law or a public authority says we must share the personal data; or
  • To protect the safety of our employees, the public or SightLogix property; or
  • Required to comply with a judicial proceeding, court order or legal process; or
  • In the event of a merger, asset sale, or other related transaction; or
  • For the prevention or detection of crime (including fraud).
8. How do we protect and store the personal data we collect?

We recognize how important your personal data is to you, and we seek to take all reasonable measures to secure your personal data. We are fully committed to protecting the confidentiality and security of the personal data that you share with us.

We utilize computer safeguards, such as firewalls and data encryption, and we enforce physical access controls to our buildings and files, to keep this personal data safe. We only authorize access to those SightLogix employees who need to access your personal data in order to carry out their job responsibilities.

  • We protect the security of your personal data while it is being transmitted, by encrypting it using Secure Sockets Layer (SSL).
  • We enforce physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personal data. We may occasionally ask for proof of identity before we share your personal data with you.

While we take all reasonable technical, physical and organizational precautions to ensure the safety of your personal data, no system is 100% secure, even when encrypted and the transmission of information via the internet is not completely secure. So, while we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Website. Any transmission is at your own risk.

9. Transferring your data

Your information may be transferred by any SightLogix or SightLogix partner company in any country, including countries outside of the European Economic Area (EEA), for processing, storage, administration or any other use stated in this Policy. The purposes and processing associated with any such transfer will comply with all applicable data protection regulations. Where information is transferred outside the EEA, and where this is to a SightLogix affiliate or vendor in a country that is not subject to an adequacy decision by the EU Commission, data is adequately protected by EU Commission approved standard contractual clauses, an appropriate Privacy Shield certification or a vendor’s Processor Binding Corporate Rules. 10. How long we store your personal data

We will only keep your personal data for as long as is necessary to fulfil the purpose it was initially collected for. The length of time we store and utilize your personal data will therefore vary, depending on your initial contact with us. Afterwards, we may retain data for an appropriate period to protect ourselves from legal claims, to administer our business, or to the extent permitted by applicable law, which may require us to hold your Personal Information for specific periods. We will delete your Personal Information, when you withdraw your consent, if there is no other legal ground for further processing (e.g. a statutory obligation to retain your Personal Data), or when you object to the processing in accordance with “Your Rights in Relation to Your Personal Information” (see below) or when we are obliged to delete it in accordance with an obligation under applicable law

11. Your rights

11.1        You may be entitled to ask SightLogix for a copy of your information, to correct it, erase or restrict its processing, or to ask us to transfer some of this information to other organizations. You may also have rights to object to some processing activities, such as the profiling we may perform for the purposes of direct marketing, and, where we have asked for your consent to process your data, to withdraw this consent (all requests as per this section are jointly referred to as “Individual Rights Requests”)

These rights may be limited in some situations – for example, where we can demonstrate that we have a legal requirement to process your data. In some instances, this may mean that we are able to retain data even if you withdraw your consent.

We may require proof of identification before fulfilling Individual Rights Request, so please provide clear and easy means on communicating with you, so, if it becomes necessary, your identification can be confirmed quickly and easily, and so SightLogix can meet its obligations in terms of the duration SightLogix has to respond to any Individual Rights Request you make.

11.2        Where we require personal data to comply with legal or contractual obligations, then provision of such data is mandatory: if such data is not provided, then we will not be able to manage our contractual relationship, or to meet obligations placed on us.  In all other cases, provision of requested personal data is optional.

12. Changes to this Privacy Policy

This Policy may, from time to time, change. Such amends might become necessary due to the need to keep the Policy up to date, given changes in SightLogix business practice or in response to legislative changes, and whether they are international or national changes, and may be made without prior notice.

If there are any significant changes made to the use of your personal data, which differs from that which was stated at the time your personal data was collected, these changes will appear in this privacy statement as a notice.
